    UK GDPR applies equally to both models, but the obligations are more visible with an AI agency because lead data flows through automated systems at speed. A reputable AI agency will document its data-processing activities, provide a data-processing agreement (DPA) as a data processor, store personal data on UK or adequacy-decision servers, and configure retention periods and deletion workflows. The key questions to ask any AI agency: where is data stored, what is the lawful basis for processing (typically legitimate interest or consent), and how are Subject Access Requests handled? A traditional agency is also a data processor subject to the same obligations — it simply tends to move data more slowly and manually, which reduces but does not eliminate the risk.
